Tho, gotta admit, I don't think it's particularly productive to worry about 'what is art?'. I think people get too distracted by wondering whether something is 'art' or not.
I think it's much more interesting to consider the meaning of a text (or work, etc).
I'm with Roland Barthes on the most interesting factor being the point of interpretation by the reader (or viewer, etc), not what the intention of the creator was.
So you could say, that the 'art' resides with the audience, not the creator.
On the charge of theft, as Picasso said, "Bad artists copy. Good artists steal".
